The DSEAR duties — and where software fits
In Great Britain, the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) require employers to assess the risks from dangerous substances, put control and mitigation measures in place, classify areas where explosive atmospheres may occur and control ignition sources, prepare for emergencies, and inform and train employees; in Northern Ireland the equivalent duties are set by the Dangerous Substances and Explosive Atmospheres Regulations (Northern Ireland) 2003. Those are specialist engineering decisions that must be made by competent people. What is DSEAR and who does it apply to?
In Great Britain, the Dangerous Substances and Explosive Atmospheres Regulations 2002 (DSEAR) apply to workplaces where substances could cause harm through fire, explosion or similar energetic events (and corrosion of metal) — for example flammable liquids and solvents, LPG and other flammable gases, and combustible dusts; in Northern Ireland the corresponding Dangerous Substances and Explosive Atmospheres Regulations (Northern Ireland) 2003 apply. Employers must assess the risks, put control and mitigation measures in place, classify areas where explosive atmospheres may occur, control ignition sources, prepare for emergencies, and inform and train employees. Does Complys carry out hazardous-area classification (zoning) or select ATEX equipment?
No — and this is an important boundary. Hazardous-area classification (zoning) and the selection and certification of equipment suitable for those zones (for example ATEX-rated equipment) are specialist engineering tasks that must be carried out by competent people. Complys does not perform zoning or choose or certify equipment. What it does is hold the resulting DSEAR risk assessment, the control-measure and inspection records, and the training evidence, so the whole picture is kept current and can be evidenced.
What DSEAR records does it keep?
Your DSEAR risk assessments and their review dates; the control and mitigation measures and any remedial actions; a schedule of inspection and maintenance for equipment and controls in dangerous-substance and classified areas; training and information records for the people involved; and the evidence and audit trail an inspector or auditor would expect. It does not replace the competent DSEAR assessment itself.
